Why do we need your express consent to use them?

The ruling of 1 October 2019 of The Grand Chamber or the European Court of Justice
The ruling of October the 1st 2019 of The Grand Chamber or the European Court of Justice must be interpreted in the sense that the consent is not given validly when the storage of the information, or the access to the information already stored in the terminal equipment of the user of an Internet website, through cookies, is authorized through a checkbox ticked by default from which the user must remove the mark in case of declining their use. In this sense the authorization must be based on an explicit acceptance or rejection from the user and on providing more information about the cookies.
This interpretation cannot change whether or not the information stored or consulted in the terminal of a user of an Internet website consists of personal data.
The Grand Chamber of the European Court of Justice also sets in this ruling that the information that the services provider must give to the user of a website in Internet, must indicate the time during which the cookies will remain active and the possibility that third parties could have access to the information stored in these cookies. This requirement is set by the version modified by the Directive 2009/136 that changes the article 5, part 3 of the Directive 2002/58 EU and by the Guide of the APEPD of July 2020.
